1.1. Halyk Bazar (the "Platform") is an electronic service (marketplace) available at halykbazar.kz that enables users to post information about their goods and services and to make purchases.

1.2. Use of the Platform's services constitutes the User's unconditional acceptance of this Agreement. If the User does not agree with the terms, the User must stop using the Platform.

1.3. The Administration may amend this Agreement unilaterally without special notice. The new version of the Agreement takes effect from the moment it is posted on the website.

1.4. Terms used in the Agreement:

• Administration — BMC Sales LLP, which holds the rights to manage the Platform.
• User — any individual or legal entity using the Platform's services.
• Seller — a User registered with seller status who posts offers to sell goods/services.
• Buyer — a User who purchases goods/services on the Platform.

2.1. To get full access to the Platform's features (making purchases, creating an online store), the User must complete registration.

2.2. When registering, the User undertakes to provide accurate and up-to-date information, including a phone number, email address and company details (for legal entities).

2.3. The User is personally responsible for keeping their login and password (including SMS confirmation codes) safe and secure, and for all actions performed under their account.

2.4. The Administration may block or delete a User's account if it finds that false information was provided or the Platform's rules were violated.

3.1. User's rights and obligations:

• The User undertakes to use the Platform only for lawful purposes and not to infringe the rights of third parties.
• The use of any automated scripts, bots or parsers to collect information from the Platform without the Administration's written permission is prohibited.
• The Seller undertakes to fulfil orders in good faith, deliver goods of proper quality and comply with the Law of the Republic of Kazakhstan "On Consumer Protection".

3.2. Administration's rights and obligations:

• The Administration may moderate content and remove any materials that violate the law or the Platform's rules.
• The Administration undertakes to provide technical support for the Platform and to protect users' personal data in accordance with the Privacy Policy.

4.1. The Seller is solely responsible for the information posted in product descriptions (price, availability, specifications, photos).

4.2. The sale of goods withdrawn from civil circulation or restricted in circulation under the laws of the Republic of Kazakhstan (weapons, narcotic substances, counterfeit products, etc.) is strictly prohibited.

4.3. By uploading content to the Platform (photos, videos, texts), the User grants the Administration a non-exclusive, royalty-free licence to use such content for the Platform's advertising and marketing purposes.

5.1. Access to basic features is free for Buyers. Terms of use for Sellers (tariffs, subscription fees) are governed by a separate document, "Business Tariffs".

5.2. The Halyk Bazar platform may use a transaction protection mechanism (escrow). In that case, the Buyer's payment is held in a transit account and transferred to the Seller only after the goods have been successfully received and checked.

5.3. The Administration is not liable for failures of payment systems and partner banks providing acquiring services.

7.1. This Agreement is governed by and construed in accordance with the laws of the Republic of Kazakhstan.

7.2. All disputes and disagreements are resolved through negotiation. If no agreement is reached, the dispute is referred to the court at the Administration's location (Astana).
